Terms of Use

1. Acceptance of these terms

By accessing or completing the Clearness Organizational Accountability Diagnostic ("the Diagnostic" or "the Service"), provided by Clearness Coaching Limited ("we," "us," "our"), you agree to these Terms of Use and acknowledge our Privacy Policy. If you do not agree, please do not use the Service. The Diagnostic was previously named the "Organizational Accountability Chain Snapshot".

2. What this Service is, and is not

The Diagnostic is a diagnostic tool that helps organizational leaders reflect on how accountability works across their organization. It is designed to be used as part of a professional consulting engagement.

The Diagnostic is not:

• A clinical, medical, or psychological assessment or diagnosis.
• A substitute for professional legal, financial, or HR advice.
• A guarantee of any particular organizational outcome.
• An evaluation of you or of any individual on your team.

Your results are a starting point for reflection and conversation with your coach. They are not a definitive judgment about you or your organization.

3. Who can use this Service

The Service is intended for individuals invited to participate, typically executives or leaders at organizations engaged with Clearness Coaching. Your access link is personal to you and should not be shared with others.

4. Your responsibilities

When using the Service, you agree to:

• Provide accurate information to the best of your knowledge.
• Keep your personal access link confidential and not share it with others.
• Use the Service for its intended purpose of honest reflection, and not to test, disrupt, or attempt to access data that belongs to others.

5. Reports

Your individual report is provided to you for your personal and professional use.

A team report may be prepared for the organization that commissioned the engagement. It is intended for that organization's internal use, and it presents group-level results only, as described in our Privacy Policy.

6. Intellectual property

The Diagnostic's questions, scoring methodology, report design, and all related content are the intellectual property of Clearness Coaching Limited. You may not republish, resell, or distribute the survey instrument or its methodology without our permission.

7. No warranty

The Service is provided "as is." We take reasonable care in building and operating it, but we do not guarantee that it will be error-free, uninterrupted, or suited to your specific circumstances.

8. Limitation of liability

To the extent permitted by law, Clearness Coaching Limited is not liable for any indirect, incidental, or consequential loss arising from your use of the Service. Nothing in these terms limits liability that cannot legally be limited.

9. Suspension and access

We may suspend or revoke access to the Service for any individual or access link at our discretion, including in cases of misuse.

10. Governing law

These terms are governed by the laws of Hong Kong. Any disputes arising from these terms are subject to the jurisdiction of the Hong Kong courts.

11. Changes to these terms

We may update these terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
